Legal Question in Family Law in New York

My daughter is coming home to NY from NM with her baby in August for a visit. She is asking if she could file for a divorce while shes here. Is that something she could do,or does she have to do it in NM? Also, would it mean she'd have to return home with the baby immediately?

Since your daughter does not meet NY residency requirement, she needs to do in NM
