Legal Question in Family Law in New York
my daughter has been in family court for 5 months now. it started because her ex refused to pay his 50% of child care for the 2009-2010 school year and part of 2011-2012 school year. she has since lost her job because of the monthly trips to court. the magistrate continually adjourns the hearings for her ex to provide documentation which he never does. she is clearly favoring him for some reason. they will be going back for the 6th time in march 2012. her ex was told to provide her with hia documentation by the magistrate before they appeared in january of this year. he did not. he came into court again on january 26 2012 without his 2010 corp tax return. he submitted a 2009 corp tax return after 3 attempts to get it that wasnt signed or dated by his cpa or himself. the magistrate has said that she doesnt care because she's there from 9 to 4 5 days per week. she also said that for this "trial" scheduled for maech 14, 2012, they will be lucky to get an hour of her time. my daughter's ex is self employed as an owner of a deli. he sent an email telling my daughter he has all the time in the world!
