Legal Question in Family Law in New York
My Daughter Needs Legal Help
My daughter is involved in a very heated child custody case. Her husband has been harrasing her for custody since the case began, and leaves her threatening messages about the children. Unfortunatly, she does not have the money to fight back at this moment and isterryfied of him gaining custody of her two children whom he does not care about (he has stated many times that he dosent care what happens to them as long as she dosnt get them) Is there any way that we could retain your legal services through a small monthly payment plan or at any discount. My daughter is in a desperate situation and is in desprate need of a good lawyer to fight for her in court. I hope to hear from you soon as this is an emergency.

You didn't mention what her husband is using for money. If he has funds, the Court can award counsel fees to the non-titled spouse in order to have a level playing field.
Is there a house? Are there assets? If so, your daughter may be able to obtain a mortgage loan from a close relative.
She may also want to ask her attorney to bring a pendente lite Order to Show Cause.

Your daughter should contact the Bar Association of the county where she lives. She may qualify for their "pro-bono" program. Also, the bar association may know of attorneys who will work at a reduced rate in certain cases.
