Legal Question in Family Law in New York

My daughter lives with us with her 6 month old son. The child father (ex BF) live in a mens shelter. Has not even given a dime to child support. Both are on and off drug abuses. Recently my daughter has has other problems that may require her to go to jail. If this happens, will they give the baby to his father, foster care or us ? We love him more than anything and have raised her since he was born.

You should go to family court and file a petition for custody under the best interests of the child but be prepared for a long and expensive struggle. It will most likely go to trial but you must prevail for your grandchild.
