Legal Question in Family Law in New York

My daughter is 16 and lives in NY with her father , he has custody.She is coming to stay with me in NC for the summer and wants to stay. Do i have to go through the court system ? I am worried i will get in legal trouble or they will force her to go back

If the father consents in writing that you will have custody of the child in NC, then the consent must be placed in writing, signed, and acknowledged by the father. If the father does not consent to the change in custody, you would have to petition the court for change of custody.
