My Daughter is with me in NEW York 8 Months
Me and the mother of my 8 year old moved from New York to Florida 7 years ago. We decided to separate and i left to New York with my daughter. My daughter has been with be in New York For 8 months now. Both me and the mother agreed that she would go with me. Know i want to file custody for my daughter and i know that her mother will contest it. Question: Does she have to be in New York to contest it?
Can she take my daughter away from me now?
THe mother hasnt said anything about taking her away from me.
Will her mother need to show up in New York if she contest it and if she doesnt will i get custody of my daughter. Well they send my daughter back to florida even tho she is now consider a Resident of New York?

The longer you are taking good care of your daughter here in New York, the harder it will be for her mother to get her back. I need to hear more about your situation in order to give you proper advice, but it seems that you may want to be ready to file a petition for custody any time, while holding off doing so for as long as you are sure the mother is not actually taking steps to disrupt the present arrangement. Unless there are problems with the care or environment you are providing for your daughter, you are already in a good position to keep custody. Document all of your work and activities in caring for your daughter, as well as all communications and acts of the mother regarding the child.
