Legal Question in Family Law in New York

Can I take my ex daughter-in-law to court for grandchild visitation? She and my son are separated, and she was dropping my 2 yr old grandson off every other weekend for visits. My son lives with me. She stopped suddenly for unknown reasons, and I want to see my grandson. I've tried texting, emailing, and calling her, but I never get a response. I've left voice messages asking why I haven't seen him, but she won't return my calls. My son doesn't seem to be concerned about seeing his son, but I want to see him and want to know what, if anything, I can do about it. I live in Onondaga Count, NY.

Generally, the answer is yes. You have to demonstrate an ongoing relationship between you and your grandchild - which, according to your question, you have.

The one issue I see in your question is the fact that your son lives with you. Why does your son not have visitation and why are you unable to see the child when your son has visitation. Those are two issues that will be addressed in Family Court.
