Death of a spouse
I live in New York City and my husband died without a will. His employer will not release to me his final payroll because they said I am not legally entitled

You would have to petition the Surrogate's Court for Letters of Administration. With the letters, you would be able to have the employer write a check to the estate, which would be deposited in the estate's bank account. The estate would than distribute the money under NY Intestacy laws.
