Legal Question in Family Law in New York

debt division after a divorce

During my divorce, debt division was not covered. Now, almost two years after the fact, my ex-husband has agreed to release me from the debt under my name that is really his. How complicated is the process to have the debt removed from my name if he is completely willing? Is there any way to pull up a legal document making it so, or is it necessary to make a motion to amend the divorce decree?

You may not have to change the divorce decree. You can draw up an agreement regarding your husband indemnifying you against that particular debt. Get back in touch with your attorney to do so.
