Legal Question in Family Law in New York
Debt
I am trying to get legally separated. In the meantime, my husband is not giving me enough money to pay the household bills. He has let the food run down to the minimum and we are 3 months behind on almost all our bills (including the mortgage). He is doing this purposely so I cannot afford to divorce him. He wants to ruin my credit and get so far in debt that I will have to stay married to him. He has two jobs that provide him with plenty of money but he only gives me one paycheck. He uses the other paycheck to pay expenses in his name, except for the house. I am fearful that he is trying to go into foreclosure so I do not end up with the house. We have two children, ages 7 & 3.I gave up my career to have a family which is what we agreed on. Little did I know how he would hold it over my head.I am almost finished completing a college degree so I can get a full time job that will pay well and provide me with benefits and a retirement fund. I am at the end of the rope and I need legal advice as to what I can do. I have been manipulated by him enough and I have to get out of this situation and fast before I lose my house. Any information would be appreciated. Thank you

Re: Debt
Your recourse is to file for divorce (not separation) and at the same time make an "order to show cause pendente lite", which means that you will ask the Judge to order him to pay certain expenses "pending the litigation".
