What is defined as nursery school?

If in a divorce settlement it is states that the husband is required to pay 1/2 nurserey school in addition to child support. Child is 3 and mom sends him out to a ''school'' that he attends for 3 hrs per day 3x weekly. Does this fall under nurserey school guidelines since it is part time. Mom is just trying to free up time for herself. Does father have to pay these fees just because mom is being lazy and wants to generate some free time for herself until he goes to a legitimate nursery school?

Without reading the exact language of the settlement agreement it's impossible to be certain, but it certainly would seem to fit within the qualifications of nursery school, and thus under the requirement.
