Depositions

It is legal to conduct a deposition of a witness for a case in NYC Surrogates court without notifying the defendants or the defendants lawyers. and then conducting the deposition without defendants or their lawyers being present and having a chance to participate in said deposition

Generally, all parties to a legal proceeding have the right to receive notice of a deposition and to participate in taking it. If the deposition has already been taken, an application should be made to the court to have the deposition continued at the expense of the party who failed to provide notice.
