Dimissed downward modification

I became disabled in11/05 (amputation of leg). As a result i was awarded SSD 16 months after filing my application. As a result of waiting 16 months I accrued arrears for my daughter's child support, but i was denied a downward modification by the magistrate and subsequently the judge dismissed the case. As a result my child gets @ $1,700.00 a month and I get less than 700.00. this has left me homeless because of the inability to pay rent. can I sue If the appellant court reverses the dismissal?

If the Court is reversed, there would be no one to "sue". It just means that you would have a downward modification of child support.
