Dissipation of marital assets
In an action for divorce, what are the primary factors involved in proposing or defending a claim that the adversarial spouse has dissipated the marital assets by a loss of income (failure to hold down a job, frequent changes of employment, etc) during the marriage?
In the present case at bar, in a marriage of 18 years, plaintiff wife is pursuing an equitable distribution of the marital assets entailing that she receive the bulk of the marital assets, on the theory that the husband defendant has failed to provide adequate income to sustain the life style of the marriage and to cause plaintiff wife to use her private monies obtained through inheritance to pay the expenses of the marriage. Defendant husband has had frequent employment changes due to various reasons.
