Legal Question in Family Law in New York

Distributive award in Bancruptcy

Have a voluntary separation that i entered into without full understanding of the hardship i was placing upon my my self. Part of this agreement was that i would give a distributive award to my spouse of paying 100% of her living expenses until the day i retire from my job and then it will be reduced to a flat rate and be considered maintenence. I am considering filing bancruptcy because I can not possibly pay my own debts and comply with the agreement. my question is this, when i file the bancruptcy would the court consider this distributive award as a dischargeable debt?

Re: Distributive award in Bancruptcy

You need a lawyer to examine the agreement, evaluate your financial condition, and advise you accordingly. It may be possible to set aside the agreement.
