Legal Question in Family Law in New York

Divorce or Annulment?

I live in the state of New York. Two years ago I got married and the following day I found out that the person I married was already married. We separated that very moment. He just got divorce last year. I am not sure if my case qualifies for a annulment. A week ago I went to a attorney to start a divorce. Do I still need a divorce? Can I stop the divorce and get a annulment instead? I have a copy of the divorce, first marriage certificate and my marriage certificate.

Re: Divorce or Annulment?

You were never legally married. You will have to bring an action to declare the marriage void.
