Legal Question in Family Law in New York

divorce contested

If the wife initiates the divorce and has no evidence to support her request can she still receive a divorce. Is she still entitled to any compensations if she wants the divorce and I don't

Re: divorce contested

She should not be able to win if she doesnt have sufficient facts to support her allegations, but, why stay with one who does not want you? Think hard about contesting the divorce. This same line of thought does not apply to asset distribution, custody and support.

Re: divorce contested

I will need further information to answer your question. Are you saying that she will not be able to prove the allegations that the grounds for divorce are based? If that is the case, yes, she would be unable to get a divorce in in New York State. As for compensation, I need further facts on children, lenth of marriage, and other factors.
