Legal Question in Family Law in New York

I am going through a divorce and i am the cosigner to our house loan we purchased before we got married. I havnt lived there in a year and i havnt been making the payments since i moved out she has been making the payments. i wont my name off the loan. What is the best way of getting that done?

It is really up to the bank as to whether you can be removed from the loan or not. In my experience, banks will not take co-signers off of loans. The quickest and easiest way to get your name off of the loan is to work out an agreement with your spouse (assuming your intention is to give her the house), whereby she gets title to the house free and clear if she refinances in her name and pays off the underlying loan for which you are a co-signer.
