Legal Question in Family Law in New York

My ex-fiance remarried his 2nd wife (after 5 years of divorce)in 11/2006. He now finds that he does not want to be with her and wants to move out and get a divorce. Although he ultimately made the decision to remarry her again, she married him knowing he had doubts about doing so and that he was still in love with someone else. They have no children together, do not own anything together and do not and never did share bank accounts or credit cards. What is the best way for him to go about getting a divorce-legal separation or straight for divorce. She said she will not give him the divorce. Additionally, she incurred relocating charges and some furniture purchases days prior to the marriage-will he be held liable for these purchases.

Your friend should consult in private with an attorney. It appears that the divorce will be contested so he will need to allege and prove his grounds for the divorce.

Generally there are two ways of approaching such a situation. There are very specific situations where the best route to go would be to simply file for divorce directly and bypass the whole one year waiting period for good, or in some situations you have no real grounds ot go that route so the legal seperation may be the only route to go.
