You are asking for specific advice, which is impossible to give on a message board.
If you are unhappy with your lawyer, you should consult with another one or two, to get a second opinon. If your current lawyer failed to request for counsel fees, it might be a mistake, and it might be fixable. It also might be due to your husband not having income or assets too.
