Legal Question in Family Law in New York

Currently going through a divorce. My husband received an inheritance in '02 from his father. In '04 we married and then purchased our home. He used $30,000 from that inheritance as a downpayment on the marital home. If we were to sell the marital residence, would he be entitled to this money from the proceeds - or at anytime in the near future that we do sell the house?

Yes. His separate property was the source of the downpayment on the house.
