Legal Question in Family Law in New York

My dad had married a woman who he fell in love with. But, she was not a citizen. However, he helped her get established as well as her son.

They were married for about five years. But, now she is threathing to take some money from him. As far as from the divorce preceedings. He's nerves because he was a very hard worker and basically doesn't know enough english to help him get by. Nor does he know law. My question is this is she able to collect on just the that they were married

your father needs a lawyer fast. in a divorce the issues can be tricky and your father needs representation. don't let him try this on his own.

In a divorce, the marital estate (generally, property acquired by either spouse during the marriage) is equitably distributed among the parties. The Court weighs several factors in determining how much to award each spouse. Also, the parent who has custody of a minor child is entitled to support from the other parent. Finally, the Court may award maintenance (alimony) in appropriate circumstances to help a lower-earning spouse maintain his/her standard of living. Your dad should consult with an ewperienced attorney to understand his options and potential exposure in a divorce.
