Am i legally entled to pay my bills with my husbands bank account now that we are starting a divorce?

That depends on what you have been doing. If your husband allowed you access to the account to pay your bills and the source of the funds are the same source then it should not be a problem. If however, you have not had access in the past, these bills are entirely your responsibility then he can ask for that money back as part of settlement or taken out of possible settlement you would get.

Assuming you were not a signatory on the account, you were never entitled to pay your bills, or even his bills, with his account unless you had a Power of Attorney.

Assuming the account has marital funds within it, You should speak to a matrimonial lawyer to determine if you can force your husband to either split the account so that you may pay bills or make him pay them. You should at the very least have the court stop him from disapaiting the account during the course of the Mat action.

If you are not named on an account, you are not entitled to use it, w/o specific authorization from the owner of the account.

If you NEED spousal support, before your divorce action concludes, you may file a Court Motion, for interim, temporary spousal support.

You may also include in your Motion an application for a Order for your husband to pay, in the interim, your joint outstanding bills, that he usually paid, such as rent, mortgage and utilities.
