Legal Question in Family Law in New York

Divorce NYS

I served my husband with divorce papers three weeks ago. He is contesting it when he answered Oct. 10, 2008. I am now seeing someone new and wondered if this could be a problem and considered infidelity. Can he use this against me if he finds out? We have lived apart for 3 months. Thank you for your help. Having sexual relations with another individual prior to divorce is deemed adultery.

However, he would "use it against you" for the purpose of obtaining a divorce, something that you wanted in the first place.
