I have an open index number in a New York court pending for divorce (stipulation of settlement) since 1998 can I amend this and receive judgement now

Not likely, failure to file a complaint, or serve same, within 4 months of the purchase of the index number usually means the case was dismissed as abandonded. Call the clerk of your court and see if the index number is still viabile, Then proceed as you feel is best.
