Legal Question in Family Law in New York

Divorce papers

I got divorce papers online. Could I fill them out myself or does a lawyer have to? Also, if I could fill them out myself do I have to have it printed or could i do it in pen?

Re: Divorce papers

David and Joel are correct. However, one other thing. If you received the divorce papers online from the New York State Office of Court Administration, the online papers do not include a settlement / separation agreement which you need to get divorced.

Re: Divorce papers

There is no legal requirement that a lawyer do your papers. However, depending upon the complexity of your case and your familiarity with court procedures, you may be very well advised to have an attorney handle your case.

Re: Divorce papers

You are legally allowed to fill out the papers yourself and submitt them to the court. I do recomend that you sit down with an attorney to discuss the matter and determine the best course of action.

If you have children, own a home, have a pension, investments, or own a business among other things, will complicate a divorce case and make it very difficult to represent yourself or do an uncontested divorce.
