A spouse" need not agree or consent to a divorce.

However, the "other spouse" MUST have NOTICE of the Divorce Action, before Entry of a Divorce Judgment, by being duly and properly served.

You can not get divorced if, after being properly served, the other spouse files an Answer denying the actions complained of (fault) in complaint. You may have to go to trial.

However, if after being properly served, the other spouse ignores the complaint and does not file an Answer, you can get divorced by default.
