Legal Question in Family Law in New York
Divorce and property
I am interested in finding out if I have any rights as to the marital property----my ex-husband and I have been divorced since 2006 and my name is still on the deed and mortgage however when we separated we didn't put anything in writing as to who receives what---it was a generic 1 yr separation agreement that turned into divorce decree.

Re: Divorce and property
It is hard to believe that a lawyer would not have divided all of the marital property including debts, and assets such as the deed.
If there was a divorce, and the house was not disposed of in the divorce decree, the title to the house which starts off as husband and wife, not become yours and his, as not being married. Why this is significant is that you can force the sale of the house either by agreement or by partiton.
You are in great shape to receive 1/2 of the equity of the house.
You may have significant equity in the house that can be secured through a sale.
Don't delay in seeking legal help. A dollar in the bank is worth two dollars in a house today.
