Legal Question in Family Law in New York

Divorce without property settlement

Approximately 1 1/2 years ago I began several attempts at reaching a property settlement with my spouse including a Separation Agreement. She claims to want to settle but never follows through to final discussions or signs anything.

I filed an Action for Divorce in February 2001. We had a Prelimenary conference in April & a Discovery Hearing(?) in July. My spouse refuses to hire an attorney-she uses a legal service thru her union (woks for NYC gov't agency)for court papers & hearings.

The next hearing (a compliance conference)is scheduled for October. All financial papers have been exchanged. What actions can I take to just get divorced now and settle the property issues later? Thank you.

Re: Divorce without property settlement

The judge will force the issue of the property settlement at the compliance conference.

You will have to come to some financial settlement before you divorce.
