Legal Question in Family Law in New York
Divorce question
I have a friend whose very dear to me and I hate to see him suffer like this.
Hes married for little over 25 years, they have one child whose now 23.
He wants out of that marriage because shes abusive, mentally and physically.
He tried to start a divorce like 9 years ago, then she blocked all accounts and he decided not to pursue it.
Since then things have become worse and worse, she's even mentally abusive to their son.
They have a house on Long Island, he pays the mortgage of over $1400 a month and most the bills.
She only started working again because the bills were pilling up.
She never really contributed money wise in that marriage, from the 25 years that
they are married she only worked 6 years, the rest of the time she stayed home and took care of their child.
My friend has a 30k a year income, he doesn't see a way out of that marriage besides
taking off and disappear.
I know with her attitude she will fight the divorce and go after every penny he has.
Is there a chance for him to get out of this marriage without loosing everything?
Is there such a thing as a affordable lawyer for him? and how does he find one?

Your friend can get what he wants.
Re: Divorce question
Under the DRL, property is to be equitably
distributed. This usually means 50-50
after the payment of debts. This includes
pensions.
Earning only 30K, the amount of maintenance
will be an interesting question. Because
of the lack of a work history, maintenance
will be ordered. The question will be how
much. With modest earnings, this will
be an interesting figure
Affordable attorneys are hard to find. Too
bad you weren't in Monroe County. Then I would
do it.
In Nassau, I know of no one. In Huntington
I hear tell that there is a legal clinic
at the old Toaz Junior High School sight
and I do know Janet Singer and Jim Margolin
are good matrimonial attorneys but I do not
know what they charge
