Divorce question

Can I sue for adultry? and what if there's a child

involved... i dont want to lose my son or just be given

weekend visits. Does adultry hold any weight against my

wife?

From your question I am not sure what you want to sue for. If you want to sue for divorce based on adultery, you can.

Divorces in New York do not assign fault, and nothing is decided based on fault. Neihter you nor your spouse will lose visitation rights because of adultery. Even though adultery is morally wrong, it does not give you any advantage in court for a divorce.
