Legal Question in Family Law in New York

Divorce Question

I have been in a tumultuous marriage for 2 years and would like a divorce. My husband is self-employed D/B/A and I am a full time college student. I own nothing personally. I have been working for him for 3 years and I go to school. He has total financial control. What am I entitled to? Am I entitled to half of whatever is in the bank? Will I be entitled to maintenance? We have one joint bank account with $10,000 in it from wedding gifts. He has other ''business accounts'' with large sums of money in them. I am afraid to leave because I have nothing. The car he purchased for me to commute back and fourth to school is also in his name.

Thank you in advnace, as your advice would be greatly appreciated.

Re: Divorce Question

The assets you acquired during the marriage would be equitably distributed. Also, you may be entitled a buyout of your interest in his business if you could demonstrate that the value of his business appreciated during the marriage.

Re: Divorce Question

You need to consult an attorney as soon as possible. Circumstances such as you have described, specifically, your being in school and his being self-employed, create various issues affecting the distribution of assets which must be properly addressed. Please call my office to schedule an appointment if you wish to discuss this further. I will not charge a fee for the initial consutlation.
