I am recently divorced from a federal employee. We were married 9 years and have two children. Am I still entitled to equitable distribution of all his assets even though this divorce was uncontested?

If you both are New York residents you should be entitled to equitable distribution of the marital property, but a lawyer would need to look at the papers that you signed in connection with your divorce. You should most definitely pursue this. Jeremy Morley [email protected]

This should really have been explained to you, in advance, by the attorney who represented you in the divorce case. If you had no attorney, then this was a case of being penny-wise and pound-foolish.

The question is what *else* was overlooked by you in the divorce settlement? Suggest you consult with an experienced matrimonial attorney to learn your rights and options.

If the Agreement was inequitable or was procured by fraud, it may be possible to have it set aside by the court.

It will now be necessary to have an attorney review the entire case, so you really saved nothing by not having a lawyer in the first instance.
