divorce & retirement monies

husband and i married in 1992. in 2002 he left, but we are still legally married. if we divorce, am i automatically entitled to part of his retirement? he is a n.y.s.c.o. and became one after we were married. thank you!

His pension is subject to Equitable Distribution of NYS. From the time he started the job til the commencement of the divorce action would be subject to distribution.
