I am still legally married to my husband, we are not legally separated, and we do not live together. I left him back in September 2008 on grounds of dishonesty, mental & emotional abuse, constant false accusations of infidelity, and he forged my signature on a document that I got stuck w/ the debt. The deed to our house was in both our names, but the mortgage and home equity line of credit was in mine, I also had credit card debt. I filed for bankruptcy because I could not afford to pay it all back. And the house was foreclosed on.
I recently found out that he has a girlfriend. Does that count and infidelity on his part since we are still legally married?
We have no children together, although he has a son from a previous relationship. I helped him raise his son. I was a homemaker for 2 1/2-3 yrs of our 4 1/2yr marriage. Do I qualify for Spousal Support even though I left him? He does earn a lot more income than I do. And should we get a legal seperation?
I know that he can filed for divorce on grounds of abandonment against me after we have not been living together for a year, will that effect me if getting or not getting spousal support from him?

In your situation, you really need to consult an attorney and retain his/her services. You may entitled to support, equitable distribution, etc.

There are many issues that you need legal representation for, such maintanence, distribution of assests, etc.
You should obtain legal services from an attorney.
