How do I get a divorce?

My wife and I split up over 3 years ago and we haven't really spoken since. We were married in New York. At the time, I was a non-resident alien. My immigration case has long since lapsed also.

I would now like to clear this matter up and get a full divorce - make the split legal, if you like. Is there a stage where a divorce becomes automatically granted, if so, how long do I have to wait? I don't think she'll sign any papers otherwise..

Divorces are not granted automatically. However, on the facts you posted, it would seem that you do have grounds to get a divorce. Assuming your spouse has no objection, it can be done relatively quickly and inexpensively.

Divorce can only be granted in NY upon a showing of grounds. Depending on the circumstances, you may be able to show abandonment. Separation can be grounds only if the couple lives apart puruant to a written agreement filed in court. Please call my office to schedule a consultation if you require additional information.
