Legal Question in Family Law in New York

I want to divorce my wife but I haven't seen her in 10 years and I don't know where she is. We separated a month after our marriage in 2001 CT, and haven't heard of her since. What do I do if I can't find her? Can I still proceed with the divorce?

Yes. You may still get a divorce. There are other numerous ways to serve your spouse if you cannot find her. You would need to ask the Court for permission. Hire an attorney.

To reiterate what another attorney has stated,you can obtain a divorce ,however the court must agree that service will be made pursuant to an order of publication. This is more conmplicated and costly than a regular uncontested divorce.You should retain a competent divorce attorney to obtain a proper result.
