Can a couple file for divorce and still live in the same apartment? There has been now sexual contact for almost 1 year.

Living in the same apartment is not a bar to obtaining a divorce. However, the absence of sexual contact must be for a period of longer than one year to qualify as constructive abandonment under New York law.
