Legal Question in Family Law in New York
No Help
I am a divorced mother of three ages 11, 4 and six. I have full custody. My ex-husband is an alcholic who does not pay child support and can not hold down a steady job. He doesnt call or visit or do anything. Can I peition to have his legal rights as a parent revoked? I am about to marry someone else who is clearly been a father to my children for the past 4 years and wants to even adopt them. What can I do?

Re: No Help
Petition to have him removed as an unstable, unsuitable, and dangerous parent.
Also cite him for failing to pay child support/alimony.

such a petition is difficult however by giving the father the opportunity to be relieved of an obligation he does not want a voluntary arrangement could be arranged . you can call me at 516 466 5297 for a free telephone consultation.
Re: No Help
There is no Petition to "Revoke a Parent's Rights."
But, you may File to have your children adopted by your husband, upon NOTICE to their biological father. If the Court grants the adoption, your husband will thereafter been your children's father; and their natural father will no longer have obligations or rights to the children.
Suggest that you discuss this matter with the natural father in the least offensive way, to obtain his cooperation.
Do not attempt proceeding on your won, your attorney should handle the adoption process, especially since it may be contested.
Good luck,
