Legal Question in Family Law in New York

Divorce/Immigration

I got married 5 years ago and the day after the signing my husband was supposed to move in. He never showed up. he simply disappeared. I know he's still alive. he had agreed to sponsor my green card.

I want to move on. Divorce? Annulment? And can I handle this without representation?

You may have grounds for a divorce. I suggest you retain counsel.

This is a difficult situation, but I can give you a specific and complete answer.

You have grounds for a divorce under the 'Domestic Relations Law'. The grounds is 'abandonment'. You can proceed in one of two ways; normal filing for divorce if he can be found or service by publication if you cannot find him. You are not required by law to have a lawyer, but a lawyer can be helpful. My own fee for this service is $250.00.
