I am an attorney and I work for a divorce attorney in Brooklyn, New York. She is Russian and handles many different types of divorce actions. Please contact me at [email protected] if you would like to get in touch with her. Thank you.
Re: Divorcing abroad?
You'll need to provide more information. Where are the parties resident? For how long? Where did the marriage take place?
Re: Divorcing abroad?
I am sorry to hear that this did not work out for you.
1. The first thing is to determine where you should file for divorce. If you (or she) has lived in NY State for at least 2 years or you were married in NY or you lived as man and wife in NY state for 1 year, then you can file in New York state.
2. The second thing is the reason for the divorce. If you both want to be divorced, then it doesn't really matter what you put down as the reason. I usually recommend 'abandonment' because it is least likely to upset the other party -- why look for a fight at this point? Other options include cruel and intolerable treatment, spouse in prison, and similar reasons.
3. The tough part is dividing up what we call the 'marital estate'. The marital estate is the increase in assets accrued during the marriage. It does not include what either had before the marriage, just what was earned during the marriage.
