Legal Question in Family Law in New York

Domestic Violenc/ Civil Court lawsuit

Hi, I was dating a guy for a few

months a broke up with him. He

started harrassing me and stalking

me and leaving me messages saying

bad things would happen to me if i

didn't see him. He threatened

suicide, i called 911. He apologized

for threatening suicide and left me

candy and flowers. I didn't go back

with him. My apartment was broken

into and everything was stolen

except for the things he bought me

and my car was vandalized. I can't

prove it was him. He also attempted

to assault me after i ignored him

oneday on the street. He has been

arrested twice giving the string of

things that have happen to me and

the constant voice mails emails ant

text messages he use to leave me. I

have a temporary order of protection

against him and he is to come no

where near me. There is a criminal

case pending against him. Now he's

trying to sue me for defamation of

character and mental abuse and lost

time from work. He's pretending to

be a victim and has told me

numerous times that he wants me

to hurt just like i hurt him when i

left. What can i do about this. Please

help.

Short of retaining a lawyer to defend against the civil action, I would contact the ADA handling the criminal prosecution and tell him or her about the lawsuit.

Criminal and civil complaints are immune from defamation of character (although a cause of action for abuse of process may exist).
