Legal Question in Family Law in New York

duties of an executor to the estate

Under NY state laws is there any laws that govern a person who is executor to an estate? Aren't they suppose to prepare a full accounting of all monies?

Re-submit this question to the Probate, Trusts, Wills. and Estates section of this website for more knowledgeable answers from more experienced attorneys in these matters.

Various sections of New York's Surrogate Court Procedures Act (SCPA) and of New York's Estate Powers and Trusts Law (EPTL) enumerate the prerogatives and duties of the executor.

Sections 2205 and 2206 of the Surrogate Court Procedures Act discuss which parties, including the court itself, can demand an accounting from the executor, and the Surrogate Court Procedures Acts includes forms called "schedules" (e.g., Schedule A, Schedule B, etc.) which the executor can use for the executor's accounting.
