Legal Question in Family Law in New York
emails found by using spyware
some of my personal emails have been found by my husband. he downloaded a stealth software unbeknownst to me on our computer. these emails are incriminating because I was having an affair. Can these be used against me in court, if we head for a divorce? We have a son together. he tells me he will do whatever he needs to, to make sure he gets full custody. please let me know

The emails can and will be used against you (as will your post admitting to having an affair if he discovers that too) and I suggest you get legal representation as soon as possible. If you would like a consultation to discuss these matter, you may contact me via email.

The e-mails can be used as evidence of an affair, however, merely having an affair does not make you an unfit parent, or necessarily grant your husband a substantial advantage in obtaining custody of your child.
