Legal Question in Family Law in New York

Emancipation of an adopted child

My step father and mom adopted a girl 6 years ago.....4 years ago she turned 16 and left him a note in his car stating she was going to go live with her mom and she is 16 and has that right. In the meantime she got pregnant...which he paid for the birth of the baby. He has never taken her off his medical insurance. Recently she has taken him to court to pay child support she feels is owed to her and NY wants their money back because she went and applied and received medicaid...what can he do about this... how can he be held responsible for medicaid when he had insurance on her? The judge says nys wants the medicaid money paid back

Re: Emancipation of an adopted child

When the judge says NYS wants the medicaid money

paid back it sounds more like a warning to go hire

an attorney than a decision. Which is what I

would do. And would try to bring in the insurance

company to reimburse as their was coverage. And

I would fight that I am not obligated to support

because I had always maintained a home for the child

and still do and she chose not to avail herself of

the facility, etc. It is not an easy task but it

can be won
