Legal Question in Family Law in New York

Emancipation of a child from Family Court

Can I compell my x to continue paying child support through the Child Support Services even that my son has reached 21/yo.

In my divorce settlement agreement I am suppose to receive child support until my son is 22/yo. My x has been paying me through the child support services all along. Now that my son is 21/yo, my x stopped paying thru the child support service and wants to pay me directly. Can Family Court force my x to continue paying me through the Child Support Service?

Re: Emancipation of a child from Family Court

If you are entitled to child support and you want it to be paid through probation, the court must order it paid through probation. There is nothing anyone can do about it. So she cannot decide to stop.
