Legal Question in Family Law in New York

Emancipation in ny

Trying to find out what this means in my new york order must i support myson until he is 21 or can he be emancipated earlier. He is not self supporting and does not live with his mother. My order reads as follows

with the respect to a child, an emancipation event shall such a termination until the soonest of any other emancipation event shall, for all purposes under this stipulation be deemed a period prior to the occurrence of an emancipation event. Does this mean i have pay my ex wife support until my son is 21 even know he is out of her house and works full time he is also 18? Please clear this up for me. We have a ny order

Re: Emancipation in ny

If he is not dependent on her for anything, i.e. health insurance coverage, then he may be considered emancipated. If you believe he is emancipated you have to file a petition in Family Court and provide proof that he is gainfully employed full-time and that he is not dependent on his mother (or you for that matter) for anything. You should speak with an attorney as soon as practicable. Feel free to contact me by email.
