Legal Question in Family Law in New York

enforcement of signed divorce judgment maintenance

Hi. A plaintiff and defendant have a stipulation of settlement where they agree that defendant pays maintenance of $1000 monthly to plaintiff. There is no income deduction order issed by the Court. The divorce judgment is then signed. Defendant pays for a month or so and then stops maintenance payments. How does one enforce payment of the maintenance award?

Thanks.

The enforcement service of the Family Court can be helpful.

A lawyer can get the job done as well.

If the Enforcement Agency does not help you, then contact me and I will meet with you for no fee and we can discuss options. This is not complicated.

Depending on the jdugment and order, you may seek to enforce by filing an application in Family or Supreme Court. You need to provide more details. I suggest you consult with an attorney who can review the papers referred to above.
