If I decide to call of my engagement, does my fiance by law have to give me back the engagement ring?

Re: engaged
An engagement ring is a gift made in contemplation of marriage. If you do not get married (and there is no legal impairment to the marriage- i.e. you are already married, the ring should be returned.

Re: engaged
If the ring was yours and you gave it as an engagement ring you are legally entitled to get it back, provided you were eligible to be married in the first place (you weren't already married when you gave the gift of the ring).
Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
Re: engaged
The simple answer is yes. A ring given in contemplation of marriage when no marriage takes place is obligated to be returned. You may call my office @718-834-0087 for further clarification.
