Legal Question in Family Law in New York

I'm engaged to this woman and we own ahome and we have a child. I recently found out she was sleeping with another man ,I have sasked her to leave the house but refuses to. what are my options.

You own the house together. Therefore, each is entitled to possession of the property. I would think that your option is to commence a partition proceeding for the sale of the house. The partition proceeding will allow you to purchase her share of the house (or vice versa).
